FibCo Networks (Pty) Ltd – Jobcard Software

These Terms and Conditions ("Terms") govern your access to and use of the Jobcard platform (the "Service") operated by FibCo Networks (Pty) Ltd ("FibCo", "we", "us", or "our"), a private company registered in South Africa. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with these Terms, you must discontinue use of the Service immediately.
1. Definitions
"Jobcard" means any digital or PDF record generated through the Service detailing work performed, materials used, time spent, signatures, and related information.
"Client" or "You" means the individual or entity using the Service, whether as an administrator, technician, subcontractor, or recipient of a Jobcard.
"Content" means any data, information, images, signatures, attachments, or materials you input, upload, or generate through the Service.
2. Service Description and License
FibCo provides a Software-as-a-Service (SaaS) platform for creating, managing, signing, storing, and dispatching Jobcards and related service records, including automation, digital signatures, co-branded PDF generation, and partner agency functionality.
Subject to your compliance with these Terms and payment of all applicable fees, FibCo grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for your internal business purposes during your active subscription period.
No ownership rights are transferred to you through use of the Service.
3. User Accounts and Responsibilities
- You must provide accurate, complete, and current information when creating an account.
- You are responsible for maintaining the confidentiality of your login credentials.
- You accept responsibility for all activities occurring under your account.
- You agree to use the Service only for lawful purposes.
- You must comply with all applicable South African laws, including but not limited to POPIA and the Consumer Protection Act (CPA).
- You may not attempt to gain unauthorized access to any portion of the Service.
4. Jobcards, Invoicing, and Variations
Jobcards represent the work, materials, observations, and details recorded at the time services are performed. Jobcards are operational records and should not be interpreted as exhaustive invoices.
Additional materials, labour, travel expenses, call-out fees, variations, or other legitimate costs may be invoiced separately where reasonably incurred during the provision of services.
Signed Jobcards constitute acknowledgement that the recorded work was performed. Such acknowledgement does not limit the right of the service provider to invoice for actual services rendered, approved variations, or necessary additional work.
Digital signatures, electronic acceptance, emailed PDF copies, and electronically dispatched Jobcards shall be deemed valid and binding evidence of acceptance.
Any dispute regarding invoiced charges must be submitted in writing within 14 calendar days of invoice receipt together with supporting documentation. Failure to raise a dispute within this period may be deemed acceptance of the invoice.
You are solely responsible for the accuracy and legality of information entered into Jobcards and any resulting invoices, quotations, reports, or records.
5. Fees and Payment
- Subscription fees and usage charges are payable as agreed between you and FibCo.
- All fees are exclusive of VAT unless otherwise stated.
- Fees are non-refundable except where required by applicable law.
- Failure to make payment may result in suspension or termination of access.
- FibCo reserves the right to amend pricing upon reasonable notice.
6. Intellectual Property
The Service, including software, databases, interfaces, source code, designs, logos, trademarks, documentation, and related intellectual property, remain the exclusive property of FibCo or its licensors.
You retain ownership of your data and generated Jobcards. However, you grant FibCo a worldwide, royalty-free license to host, process, store, display, transmit, and otherwise use such Content solely as necessary to provide and improve the Service.
You may not:
- Copy or reproduce the Service.
- Reverse engineer or decompile the software.
- Create derivative works.
- Resell, sublicense, or commercially exploit the Service without written authorization.
7. Data and Privacy
Your use of the Service is subject to our Privacy Policy.
You are responsible for obtaining all necessary permissions, consents, and legal authority required to process personal information through the Service.
FibCo processes personal information in accordance with the Protection of Personal Information Act (POPIA).
You acknowledge that digital signatures, contact information, photographs, attachments, and service records may contain personal information that must be handled lawfully.

8. Warranties and Disclaimers
The Service is provided on an "as is" and "as available" basis.
To the fullest extent permitted by law, FibCo disclaims all warranties, whether express, implied, statutory, or otherwise.
FibCo does not warrant that:
- The Service will be uninterrupted.
- The Service will be error-free.
- All defects will be corrected.
- The Service will meet all user requirements.
FibCo is not responsible for disputes between users and their clients, customers, subcontractors, suppliers, or third parties.
9. Limitation of Liability
To the maximum extent permitted by applicable law:
- FibCo's aggregate liability shall not exceed the total fees paid by you during the twelve (12) months preceding the claim.
- FibCo shall not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages.
- FibCo shall not be liable for loss of profits, business interruption, loss of data, loss of goodwill, or reputational damage.
10. Indemnity
You agree to indemnify, defend, and hold harmless FibCo Networks (Pty) Ltd, its directors, officers, employees, contractors, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses arising from:
- Your use of the Service.
- Content uploaded or generated by you.
- Jobcards generated through your account.
- Disputes with clients, subcontractors, or third parties.
- Your breach of these Terms.
11. Termination
FibCo may suspend or terminate access to the Service immediately if:
- You breach these Terms.
- You fail to pay applicable fees.
- Your activities expose FibCo to legal, security, or operational risks.
Upon termination:
- Your right to use the Service immediately ceases.
- FibCo may retain data for a reasonable period where legally required.
- Data may thereafter be permanently deleted.
12. Governing Law and Dispute Resolution
These Terms shall be governed by and interpreted in accordance with the laws of the Republic of South Africa.
Any dispute arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Johannesburg, Gauteng, South Africa.
13. Changes to Terms
FibCo reserves the right to modify these Terms at any time.
Material changes will be communicated through the Service, email notification, or other reasonable means.
Continued use of the Service following any modification constitutes acceptance of the updated Terms.
